Article One: Subject of Agreement and Scope of Mandate The second party commits to conducting a scientific and comprehensive geophysical survey and exploration of the earth's layers on the first party's land/farm to determine the extent of groundwater presence and to identify its specific coordinates and depths. Article Two: Mandatory Printed Scientific Report and Invalidation of Verbal Statements Prohibition of Verbal Report: The parties explicitly agree that any verbal statement, explicit or implicit, made by the second party regarding the presence or absence of water is not accepted or considered valid. A verbal report is considered null and void and has no legal or financial effect. Mandatory Approved Printed Report: Upon completion of field survey work, the second party commits to submitting a printed, written, and stamped scientific technical report to the first party as the primary document. The printed report must include the following data: The explicit final result of the survey (presence of exploitable groundwater or its absence). Printed graphical representations and raw digital outputs (Data Logs / ERT / VES) taken from the detection device. In case of confirming water: Specify the precise coordinates of the point, the target depth in meters, and the thickness of the water-bearing layer. In case of insufficient data for a definitive conclusion: State the explicit technical reason, the limitations in the readings, and the second party's written recommendation and the required procedure to reconcile the readings. Article Three: Right to Independent Verification and Refund of Amounts in Case of Breach Independent Verification: The first party has the absolute right to independently inspect and explore through other specialized experts and explorers to evaluate the results presented by the second party and verify their integrity and accuracy. Refund of Amounts and Compensation in Case of Breach: If the examinations and explorations by other specialized entities prove results that contradict or conflict with the second party's printed report (whether by denying what was proven or proving what was denied regarding the presence of water), the second party is immediately obligated to refund all financial amounts and recover all fees and expenses received from them in full without any deduction, while bearing full legal responsibility arising from this conflict.
